    My case is not yet approved, I Filed on Aug 01 st, Vermont Service Center.

    Can you really go for H1 stamping when you are coming back on AP.
    As far as I know, you should not use H1 at port of entry while coming back, if you do that your green card will be aboundend. Gurus please currect.

    If you are not coming back on H1, then why are you going for stamping?

    I think , if your I-485 is approved while you are out of US, then you are not supposed to enter on H1. Till that time, you can use AP to enter US, if you prefer.

    It sure seems that there a lot of frustrated people on a short fuse. Staying focused definitely helps because of both our limited resources and influence. One thing that should be considered though is the greater good. Lot's of things could help an individual's cause. If I had the power to change the law I would start of by issuing green-cards within a month of getting an H1-B. But I don't have the wishing well in my backyard. I wish one of us could locate one and that would be the end of all this confrontation!

    There appears to be a big time gap between the date one receives the USCIS email and the date the documents are actually delivered.

    . I just didnt say IIT but also REC's. REC stands for Regional Engineering Colleges (there are plenty in India) and that is not a payment seat. Education level is well maintained and by entrance examination standard, its far above GRE level. I think your generalization does not make any sense.Yes there are some decent RECs but there are also some very crapy ones.

    Yes, that's is correct. and they clarified (once more) that "when spill over occurs, PD of oversubscribed countries will move together".
    For example, if EB2 India and China has different PDs, spillover is not occuring.

    Additionally, it looks like demand in Eb1 is high enough that spill over may not be big, and so even with spill over, EB2 PD will not cross 2005. (they are saying indirectly that dont hold the hopes for big jump in the last quarter this year....)

    USCIS seems to be working very efficiently and has a good grasp on the number of applications now (at least it seems...). All that extra staff they hired for July 2007 fiasco is working now and there is not much new filing. System will stay efficient until the time comes for them to handle 12 million undocumented after the CIR.

    I think there will not much visa numbers unused. If at all, it may be in few hundreds. We are thinking our point of view, even wasting one visa number is ridiculus based on number peoples are waiting. However, the INA states that every year "not more than 140,000 EB visas should be issued".It sets only upper limit not the lower limit. Therefore DOS has be more vigilant in not exceding 140K. By doing so, there may be a few wastage of numbers. If they issue 120K instead of 140K, it is not the violation of law. Insted if they issue 141K it is vialotion of law.

    However, if the wastage is more than few hundreds it is definitly not acceptable.

    Last year they "wasted" about 10K visa numbers. It is absolutely up to them. However congress has authorized 140k a year and there are huge backlogs for AOS and CP. So when you put that together, leaving about 10K unapproved is clearly not enforcing congressional mandates. The ombudsman blasted them for this in his report, then we had the VB fiasco. None of this sounds like great management of the benefits. There clearly is room for improvement.
    We (us and our employers) as the recipients of the benefits are complaining about this, and it is perfectly legitimate.
    If any visa numbers are left unused, I definitely think we ought to take up this issue with congressional leaders like Zoe Lofgren. Even just a visa recapture legislation alone would help us tremendously until 2009(about the earliest they might get back to this issue more fully).

    Why should you contribute, because if it wasnt for IV following up with Congresswoman Lofgren, your signature would simply read:

    Yes. It may help, but EB3 is not the one who is going to get any piece out of it, as EB2 is increasing in huge amount. Even if it is CURRENT for 10 years, thats not going to help anyone below that level as everyone will qualify for EB2 in future, almost all the future candidates will have minimum of 5 years experience.


    Well, if one decided to continue the process of waiting, there won't be any career to talk about at the end.


    Not possible for all to go to EB2 as most of the companies hesitate to spend huge amount again and same is applicable to the individual too. It may not be worth at the end to spend another 5K on this. Well said, we should then fight with our own friends (because they may not like us to get the Lion's share) before going to DOS and USCIS.


    I am waking up from 'abroad' dream. The real dream in front is "Home", without any issue that works for me.
    For EB3 i think there are 3 opportunities.. one pastures are turning green near home and India is not a bad place to be at this time ( i have heard salaries of 30-35L being common these days). thats one.. combined with 1 if the employer agrees (assuming they have operations in india), EB3 can be in india for a year and come back on L1A in an executive/managerial position and get into EB1 (few of my friends have done this successfully)...that was 2... and the last one is try to get into EB2 in the US which can be risky as others have pointed out..

    so choices is there.. one has to be bold to take the step

    I watched the video and One of the things I noticed was the difficulty the State dept is facing to keep the numbers within limitation so they tend to achieve 90%-95% because the legislative limitation doesn't allow them to go beyond even by few numbers

    When i compare the same situation with that of an IPO of a company. Typically a company coming out with an IPO will have certain number of shares authorized to sell, In addition to that they also reserve certain small number in addition to these to accommodate any excess shares issued by the underwriters.

    Why don't we have some numbers similar to that. This would make the life of the State dept much easier.

    Is there any vague possibility of dates getting current once again, just like what happened in 2007 so that we can at least file for I485 and then move on to EAD because getting an H1 extn is also a very big pain these days and I'm really going through the misery and pain of it.
