PERM (labor certification) process is a requirement from the DOL and has to be fulfilled by the employer. The employer will have to bear the costs of this first step in GC which includes (filing fees, recruitment process, lawyer fees etc). It is illegal for an employer to seek this compensation from the employee. Expenses incurred in I-140 and I-485 need not be compensated by the employer.
In your case, it seems that the employer is ready to help you with all the documentation but is not ready to bear the expenses. You will have to explain to your employer how the GC Process works and the requirements of the PERM process.

Hello everyone ! 13 years ago i was charge with Lanercy-theft wich it was a 2nd deg misdemeanor and possesion of cannabis under 20 grams 1st deg misdemeanor i plead guilty and served 3 days in county jail (Florida) , now i'm 32 married to an American citizen and getting ready to adjust my status , i just want to know how hard it"s going to be this whole process , i dont want to be dinied or deported , thanks for any answers.

If your EAD is based on your husband's I-485 app I don't see any reason as to why that should affect your gc process if you move jobs.

In addition to contacting the law makers, we should be contacting the media to highlight our plight. I just read on IP that the media is unaware of the BEC mess (http://www.immigrationportal.com/showpost.php?p=1406956&postcount=3019) and would be interested in taking it up. She can't work and you can't apply for work permit. You need to wait for the I-130 approval. Then AFTER you become a U.S. Citizen, she will be able to apply for I-485 Adjustment of Status and only at that time you will be able to apply for work permit. By the way. If the I130 is approved and she goes out of country and then tries to re-enter the U.S. on a B-2 visa, she may be denied entry based on Immigrant Intent, for which B1/B2 visa does not allow. Do some research.

Here is my case details
In US from Feb 2000 - till date
PD :Aug 2002
I140 approved on Aug 2004 (no rfe)
I485 rcpt :sep 2005 pending for approval...
worked with Company A and 2002,2003 w2's are way too low 9k and 25k. Went to home country for vacation 3 times on 2004, 2005.
my 2000,2001, 2004,2005,2006 till looks okie.. I dont have any other overstay or other issue.
Applied I485 on
2005. I guess my attorney filed my 2003 w2 with my i485 petion.
I chaged from company A to company B on 2005
Will im in trouble? UN or somebody can please help?

USCIS has not extended its temporary accommodation for delays in the labor condition application (LCA) process. Earlier, USCIS agreed to accept H-1B petitions without a certified LCA, in certain situations, for a limited time. This exception was available from November 5, 2009 to March 9, 2010. The USCIS has declined to extend this exception. Accordingly, all H-1B petitions must be filed with the certified LCA otherwise USCIS will deny the H-1B petition or extension.

My cousin has a speech pathology (MSc) degreee from india and is trying for job oppurtunities in US( myself being a s/w i have no clue how this process works), can anyone of you throw some light on what kind of visa is needed, visa process involved, any consultants who can sponsor visa, and what are other things required to get started for this process. Any information is appreceiated.

At work I either use tabs or separate forms. I'm sure panels wouldn't be drastically different.

Last Friday was a depressing day for me. A businessman and his daughter visited me in my office. When I asked how they had learned about our law firm, they said a lot of flattering things about how "famous" we were and about our "great" website. Another thing I would like to mention. My I-140 got approved couple months back but applied I-485 during July 2007, so it's more then 180 days for I-485 not for I-140.
Any suggestion.

My mother has Family based green card, which she got last year. Since then she has been out of the country once and came back on 1st march 2010. My mom wants to go back to india for an year or so, to take care of some matters.....
how do we go on for filing her extension or parole or whataver its called...so that she can stay in India for maximum time and doesnt loose her GC ?

I've had my I-140, I-485 pending since August 2007 in Nebraska and i just started getting worried recently when i found out that the job title in the I-140 does not match the job name in my labor cert.
My labor cert took 4 years to be approved and in the meantime my job changed. It is still in the same field/department, in the same company, but it just evolved but still requires the same skills as the labor cert.
I was originally on H-1B and now i work with my EAD. My H1B was amended when my job changed but not the labor cert since we were well into the process when all this happened.
This is really the only concern that i have regarding the approval of my I-140 and I-485. Do any of you know if the job name difference would be a problem for the I-140 to be approved? At the least i hope they would send me an RFE and not deny it right away.

AC21 pioneers, any recommendations on picking lawyers around NYC? specifically those that are fairly responsive and charge a fair price on all the procedures / docs that come with maintaining AOS, including a possible AC21 notification letter, renewing EAD/APs....
