Hi,
My company filed for my GC in June'07. They goofed up and filed under EB-3 instead of EB-2. The company apologized and is ready to change my filing to EB-2. I am wondering whether this would be a good step? Following are my details.
- My PD is June07
- Labor is approved (in 1 week)
- I-140 approved
- My 6 yrs on H1 were completed in July09
- I have received 3 yr H1 ext
- Me & Spouse both have received EAD (I am not using my EAD card)
I am not tracking the progress of visa number availablilty, but I presume that EB-2 would anyday be better than EB-3.
Please advise whether chnaging to EB-2 would be a good idea?

That's what even I am planning to tell them. We full time employees don't work on a specific 1 project. I have got a letter from employer with job duties. Anything else needed?

I am here on L2 and then Joined a Company in 2006. When I joined, that time the H1 Cap 2007 was already over so my company said that they will do my H1 this year. Unfortunatly I got the H1 Rejected as my case couldnt get in the lottery.
In the Mean time my company have filed my Green card under EB3 and we have I-140 Approved (1 st stage) in August 07.
Now, is there any way that anyone can Help me?

Hi,
I have been doing a lot of research about this online and have even heard from friends that if you transfer your H1 to H4 and apply again for H1, your new H1 application is not counted against the H1B cap. How true is it? Has some one done this before ? Is there any risk involved? Any help would be really appreciated.

Hello,
It seems that I made a mistake in my DS-160 and my H1B got stamped with an error in my middle name. I repeated my lastname as my middle name so my full name appears as: 1stName 1stLASTNAME 1stLASTNAME 2ndLastname
I have a Tourist Visa also stamped wich is OK. Also the data on my passport.
My I797 is OK and everything else is OK.
I am still in my home country. Should I be worried about it? Should I try change it here or in the US?
In any event, what's the correct procedure to change it?

Skin test and X-ray have nothing to do with a USCIS Physician's reputation buth rather on the outcome of the physical exam. However what is important is the amount the Physician is charging for the medical examination. I have an appointment with Dr Alfred in St Louis next week at Forest Park Medical clinic. Appointments are very hard to get by in St Louis.

I am working for a client which gave me an offer for a respectable amount. it is much higher than the amount specified in ETA 9089 (F/5) column. my Onet code for the original labor is 15-1071.00. my new job is defined as System Specialist. my job functions( roles) are pretty much the same as my original labor certificate. I tried to search the Onet Code for System specialist and did not find a good match.
Can any one suggest me what are the options.
I also wanted to know weather USCIS will send any letter to new employer regarding to the offer extended to me. MY situation is the client is not willing to sponsor me.

i've been in the US on a f-1 visa since 2006. i am getting my masters at the moment. i am planning on getting married to my girlfriend who is a US citizen. i have been with her for the past 2 years and am dearly in love with her. we plan on getting married and i was wondering if i get married to her, can i apply for a green card right away or do i have to wait for a while before i can apply for a green card. she is also a student getting her bachelors.
my second question is that if i can apply for a green card then could i take a semester off and return to studying next semester or would that be a problem since i am on an F-1 visa.
i would appreciate it if i could get an answer soon so that i could take the semester off.

Hi,
I got H1-B petition (I-797) approved in 2008 but due to recession, I couldn't appear to consulate office. I did not get a chance to work in US for that employer so I don't have any pay stubs for that employer.
The petition is approved till 2011. And now I am planing to either appear for visa stamping or transfering I-797 to any other sponser.
My queries are -
A-Appearing for Visa stamping now after long time is right option or is there any chance of rejection?
B-Since My current employer is not able to employ me there,I want to transfer my I-797. Can It be possible? How much risk is there? If it can be done that what is the process of that please?
C-Since petition is valid till 2011, If I get stamped this year Oct / 2010 what will be duration of visa?
D-Any sponsrs list ?

I have a question regarding location change with same employer. I have labor approved on EB2 India with PD 01/2005. I am employed with a big health care firm which has various locations in the region. I'd like to move to another location which is 30 miles away from my present site. I140 is pending with the same employer. I have also posed this question to my lawyer but appreciate greatly if anyone knows answer to this. Will this affect my GC?

(1) I have applied for my OPT very recently with a start date of oct1, 2007 and its in the processing stage.
(2) I am planning to apply(say by August 1st, 2007) for 140/485 concurrently in EB2-NIW category, as the PDs have become current.
Will my OPT be rejected because of the pending 485? Is it possible to file 140/485 concurrent or should I wait till my OPT is approved (by that time the PDs will no longer be current...hmmm). Your valuable suggestions are needed. Pls help me....
