    As per my knowledge, You will be out of status if you didn't your H1B approval.
    So you should try alternative things, like moving on to F1 or H4 dependent Visa.

    If you have EAD you should not worry at all.

    About USCIS, sometimes it won't get updated. One of my cousin's H1B was canelled and compant got confirmation mail, But still his status shown as active from past 1 year. Make sure with your Employer (ABC/initial company who has your h1B upto Feb-2011) that they got letter from USCIS.

    Yes, you can track EAD online. All you need is case number. EAD will come to applicant address.

The USCIS is still accepting petitions at this time, but it is advised that any H-1B petitions be filed as soon as possible as the USCIS could announce that the cap is closed at any time.

    I applied for my AP in June and recently at the end of August my AP was approved. I received the AP a couple of weeks later in mail. However I noticed that instead of receiving the I-512 Authorization of Parole of an Alien into the United States, I received an I-797C Notice of Action document for me an my wife. The contents of this I-797C are exactly the same as the previous I-512s that I have filed for and received over the years.
    What I am afraid of is that this may cause problem at the port of entry when I return back from India because of the wrong title of the document.

    Has anyone else received such a a document I-797C instead of I-512 and is it safe to travel having such a document? Any advice/input is appreciated.

    Hello,

    My I-140 was approved in August 2009 and my PD is Jan-2004 (EB3). I want to know when i can apply for I-485, should i have to wait till my PD becomes Current or is there any other way by which i can file the I-485. Please shed some light on this topic and thanks for your time and effort.

    I held an H1 B Visa from 2005 to 2008. I worked in the US from for 1 year from 2006 to 2007. I had to return to my home country and my visa expired in 2008. I have been out of US for more than a year and now I am on H4 status (not employed currently) and I would like to know the below:

    1. Am I eligible to renew my previous H1 visa. Will my visa petition be considered as an extension of my previous H1 B?
    2. Will my application fall under the cap exempt or will I be subject to cap limit
    3. If the above fail, what other options do I have?

    Pls guide.

    I have got H1B after long long wait from L1B visa. I work for an MNC from the past 6 years. (5 yrs in usa and 1 yr in india). I came on L1B visa to Usa and applied for a green card EB3. My 140 is cleared in 2008 and 485 is pending(My employer says pending but not sure about that as he did not give me the reciept number). My job role is architect and leading a team of 14. But getting peanuts like 58k. I have lot of debts and clearing from 2 years and presently my credit history is recovering back to normal. Presently managing with debit cards...

    Is it a good option to switch the company at this point of time. I am in 5th year of my stay in usa and have h1 till 2012. Can you guys suggest me if it is a good option to switch a job interms of green card / continous stay in usa...

    Guys,

    Me (as primary) and my wife are July 2007 filers and have our EAD and AP till end of 2010. I also have my H1b approved till 2012 but not stamped yet. My wife currently is in AOS status (comp didn't file for her H4 ext when they applied for my 7th yr H1b ext) but she has not used her EAD. We are planning to travel India next month and get our passport stamped (H1b for myself and H4 for my wife). I've couple of questions

    1) Can someone confirm getting H4 for my wife will be treated as abandoning her I-485 because she is currently in AOS status? I don't think so but just want to confirm

    2) In form DS156 for my wife what should I answer to this question "Has anyone ever filed an Immigrant Visa Petition on your behalf ?" or to be specific I-485 is treated as immigrant visa petition or I-140 is (in which case answer to this question will be no as her gc is applied as dependent)?

    Just saw this story from a few days ago. Aside from being a hugely irresponsible way to spend a broke state's taxpayer funds, this idea also is probably unconstitutional. Does Arizona plan on having its own border control points? Will the state's wall interfere with Border Patrol activities? The federal government is supposed to control the national borders and not the states. Not that Arizona minds wasting the state's money to continue to losing that point.
