Hi All,

My employer filed for my H-1B in premium processing, but it got denied because lawyer submitted wrong EIN number.

My questions are:

Will they re-consider my case if lawyer submits the correct EIN number?

How much time will it take to process, if the willing to re-consider the case?

Hi all!

I'm currently working on a personal project of mine (word processor) and there are a few things i cannot seem to get my head around and i think that they are very simple to do too...Maybe... First, I'm trying to open a new instance of my program by simply clicking a menu option on my form. i'm using visual c# 08 express edition, windows forms application... I have attached an image (very small image) to show u what i mean.. i'd appreciate anyone's help/advice on this, thanks for reading :-)

Can H4 visa people start a company in US?

i.e company will be registered in their name.

I am on H1-B Visa and my wife on H4. She filed for GC in Schedule A(I140&I485 filed concurrently) category. Her I140 is not approved yet. We both got our EAD cards but have not worked using our EADs. I do not intend to use my EAD to work. Our question is:
* If her I-140 gets denied will she still have her H4 status as I am still maintaining my H1?
* If not, how can she get back to H4 status? Will she be asked to leave the country immediately?

Need immediate reply.

I received my EAD but my spouse EAD did not arrive and it has been more than 2 weeks. The status says Card production Ordered.

I ehard USCIS asks us to anyhow reapply, so should I have to wait untill the 30 days have passed to reapply for replacement ead or can I apply before?. Is there any way the process can be expedited as my spouse has to work on this EAD. Any info is really appreciated.

Also can we work when we have the receipt for replacement card

Hi

I did my Masters and then got a job in Company A who filed my H1b Visa on 10/01/2008 and valid until 07/25/2011.

I did not get stamped yet as i never leave US until now.

Meanwhile my employer applied for amendment as i was put into a project in another state and change in my title .

When i check the status it says "On May 7, 2010, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283."

I am going to my country on August 2nd week for my marriage and my questions are.

can i use my current I797 for visa stamping or should i use new I129 which i did not get yet?

can i use the notice as the proof of I129 in case they need it for stamping?

Also could somebody please tell me how long will it take to receive my I129 after the above mentioned status?

started as an intern with local in the month of march 06 and I was given offer till end of august. but my school official gave me work permit on a semester basis and gave it only for srping 06, which end in may 15th. I couldn't update my CPT status for 1 day for summer 06 and started on 16th may, so the school official has said that i am out of status.Since re-instatement is not possible from school as it was unauthorized work permit. They have advised me to go to home country and attend visa to be eligible for reinstatement. I have grauduated last month with masters of science..

They said they will provide me recommendation letter for me to show to consular officer. Also, I have an MBA admit in same university for spring 2007.

so should i come to new program..if thats the case how to get an emergency appoitment.

Article says "On June 12, 2008, U.S. Citizenship and Immigration Services (USCIS) informed the American Immigration Lawyers Association that the H-1B random selection process has been completed. USCIS completed the intake and receipt processes for all filings as of May 24, 2008 and began mailing rejection notices the week of June 9. Therefore, if an employer has not yet received a filing confirmation (Form I-797C Notice of Action), it likely means that the petition was not selected in the random process and that the rejection notice will be forthcoming."

Applied: April first week - it went in 2010 rush
Received: April last week
RFE: June first week
July first week: RFE response sent
July last week: Approval notice sent
August first week: approval notice received

Documents requested for RFE (also suggested by lawyer):
- Client Letter, role/responsibilities, duties, technologies used, company profile etc.
This letter also clearly stated all entities involved and their relationships with each other.
- Purchase Order and Other contract related stuff (all possible). Everyone co-operated.
- Badge (main bulding, her office), timesheets
- photos (cubicle/office building,company logo etc), login screen, machine etc, client phone directory
- copies of recent pay stub and offer letter, job duties

Thanks to everyone who contribute on this forum. It helped us a lot. This is for my wife.

My wife is on H1 since Oct 2009. No paystubs. Now she want to come back on H4. Her H4 stamping expired. I have my H1 renewed in Oct 2009 and need stamping.

What are the best and low risk options to convert to H4 status. Please advice
