My local congressman got this reply from USCIS on my AP renewal case. Its been over 90 days and pending? Please help with any advice.

The processing of this case has been delayed. A check of our records establishes that this case is not yet ready for decision, as the required investigation into the applicant background remains open.
Until the background investigation is completed, we cannot move forward on this case. These background checks are required to be completed on all applicants who apply for the immigration benefit they are seeking. Hi,
I got RFE on Advance Parole requesting proof that I have complied with NSEERS.
All I know is I went for Special Registeration back in 2003 when it initially started and citizens of specific countries were required to go for that special registeration. The immigration officer stamped my I-94 and wrote a FIN# on my passport and I-94.
Last time I travelled out of US was back in May 2001 for couple of weeks.
Now got this RFE any idea what do I need to submit.

I am currently on L1B visa since Mar09, another employer is offering for my h1b visa. I have below queries for l1 to h1 conversion process :
1) How much time I can stay on H1 if I apply H1b now ? My total stay in US on L1 is 1 year 7 months, not a continuous one !!!
2) What are the good options/approach to file for H1 considering the fact that I want work with current employer on L1B for current project ?
3) Can I apply for H1 now and later do COS any time after October ?If yes, what is the max time before I need to do COS after H1 approval ?
4) How about if my current project completes before oct 1st and I have already applied for h1 ?
Kindly help me for above questions, would appreciate your help.

Here's one question I have which I haven't see in any forums so far (perhaps its lurking somewhere .. who knows) ... let me get to the point.
When filing for AOS/485, if the I-140 that was filed prior to filing AOS was pending and gets approved AFTER 485 was filed... should we explicitly inform USCIS that that 140 was appoved ?
I guess USCIS should have that information (of course!) but I am not sure if we should be pro-active and make sure we inform the service center that the 140 was approved ?!

Due to the big mess of July visa bulliten. Can I file multiple 485 cases to secure that one of my AOS case is accepted? Since once it is rejected due to improper filing, the next visa bulliten would be back to 2006 or 2005.
My situation is:
First I-485 case: I can file I-485 as principle applicant, and my spouse can file as dependent
plan to submit at the end of this week (Aug 11, 07).
Sencond I-485 case: My spouse can file as principle applicant based on his I-140, and I can file as dependent, plan to submit before Aug 17, 2007, with cover letter stating:
If the first AOS case based on xxx's I-140 is accepted, please withdraw the second AOS case based on YYY's I-140.

Ajay K Arora from H1B1.com was a good lawyer for me. I was in KY at the time and had the luxury of choosing my own immigration lawyer. I did H1 + renewal, and RIR labor that got recently approved, but I am with a different company now, so can't use labor cert, and I have to put up with the company's law firm whose service is of course, awful.

Hi, my friend have not receive her fingerprint, her husband filed for I-485 on june 2007. their PD is 2004-ROW. their case forwarded into TSC. do you think this is normal ? what is the possible solution for this issue ?

Hi,
I applied for EAD renewal to Nebraska center on Dec 12th.
So far I didn't received the receipt and also my check didn't get cashed.
Did anybody encounter similar situation. If so please let me know what you have done.

CPA is not something thats awarded as a graduate degree by an accredited university. So probably no.
But make sure you are not shutting your option by talking to an immigration lawyer and finding out for sure if you are qualified.

it might be a little bit tricky to find this out. Talk to IO about your 485 and ask her about 140 during the conversation. She might tell you the PD on that. Once, I successfully reconformed my PD by trying this way ( I have approval notice with me though).

I will start working Jan/2007 as OPT. The company will apply H-1b for me after April.1st. At the same time, I also apply for phd program and I am not sure if I can get school offer. I believe I will know the result of phd application before the H-1b gets approved.
My question is:
If I get school offer, I know it is easy to cancel H-1b but how to cancel change of status? what is my status after I leave the company and before I go to school? what do I need to do to keep OPT until enrollment?

This is my current status
I am on H1 B visa and currently working in the US. My visa expires in July, 2011.
I was sent to the US on a long term onsite assignment from the company I was working in bangalore, India. I am asked to come back to India in June 2010.
What are the implications of me quitting thecurrent job once I go back to India? Is my H1 B visa still valid?
In case if I go back to India and move to a different company, do I have to go through everything starting from filing the H1 petition to get the H1 visa?

It is better to wait to switch after your I-140 approval ....
If you switch before, your employer could cancel the application or might not answer RFE if one is issued ...
If you are sure that employer will be very cooperative, then you can easily shift now ...
