Yesterday Congressman Joe Wilson talked to reporters about his claim that the President was lying about immigrants having access to health care subsidies under the President's health care plan. According to the NY Times: �I�m for immigration,� [Wilson] said, adding that he had been an immigration lawyer, although he did not specify exactly what he had done. �But people who come toour country and violated our laws, we should not be providing full services.� It struck me immediately that this would be bizarre if true. The Technology section of the New York Times (http://bits.blogs.nytimes.com/2009/04/13/googles-immigration-fixer/?partner=rss&emc=rss) this week ran an article about an employee at Google whose job it is to "fix" problems Google employees have with the immigration system. The article is interesting, but what is really striking is the tone of the comments to the online article. There is a display of real anger at Google's hiring of foreign workers in this time of economic hardship - when so many U.S. citizens are looking for work. Read the article. What's your opinion?

Yes, You can file for H1 extension and they will give you extension for the remaining period of 6 years.

FYI, total days of 6 years are counted based on your presence in US. so, even your out of US periods also can be recaptured.

I had a quick Q:

a.) DO you need latest paystubs for filing for 485.

Suppose, i am working for company A and company B has filed for my GC, then how can this be provided.

b.) Even if i am working for company A, do i still need pay stubs or will a letter stating that "this job is available for the immigrant" suffice.

Hi,
SEP Visa Bulletin is OUT...surprisingly EB2 INDIA 01APR2004, but it was U in the AUG...what is going on....does it mean who ever PD is prior to that date get GC...??

are you aware of the PACE bill? I am concerned that current PhD graduates and life science PhD graduates appear to be excluded from the adjustment of status benefits proposed in the bill for doctoral candidates. I have drafted a letter and would definitely like IV to publicize it.

Following are my case details -

Visa and I94 expiration date: 12 Sep 2009
Filed extension: 11 Sep 2009
Extension denied: 18 Nov 2009
Left US: 15 Dec 2009

Refiled H1 Visa: 15 Dec 2009
Visa apporoved: 22 Dec 2009

What should my answer for following question in DS-156 as I left US within 30 days of receiving the denial letter?

Have you ever violated the terms of a U.S. visa, or been unlawfully present in, or deported from, the United States?

Kindly suggest.

Can someone give me any suggestions?


I have filed for my AOS, last week.. I am assuming that i will get my EAD, AP in next 3-4 months......

a.) Once we get our EAD's can we go to India for a period of 6 months...even without receiving our physical GC? and yet return to US??

b.) After filing for AOS, can we leave US for a long period (6 months)..so in that case will we still get our EAD/AP/GC's???????


any answers?

Hi,

Gurus - I have few questions and I need your help:

1. My EAD/AP expires in June/July '08. Can I apply for their renewal now?

2. Will there be a finger-printing requirement for the renewal? We had finger print in June 2007 when we applied 485/765/131 together?

3. Is it better to efile or paper file?

4. I will be in India from April to June this year. I have an AP valid till end June. Can I file for EAD/AP renewal and leave for India in April. Is there any risk? I can still use my current AP to enter when I come in early June, right?

My father in law mistakenly entered the wrong date for his date of arrival in the U.S. (entered data in Indian style) on his citizenship application form. The number of days out of the country was also wrong.

Is there a way to rectify this mistake and inform USCIS about this ? Is there a form, or can we simply write a letter regarding the errors to the USCIS office ?

What would be the best way to address this issue ?
