    But also can some one point to me to place where it says H1B is not dual intent , i could only find DUAL iNTENT for some students.

    The chances are very good that EB2-I, will move fast this year untill sept 2009,Row EB2 and EB1 will be slowed down because of economy,EB4 is already current and over flow from FB category may provide some more visas.

    But the risks are USCIS indiscriminately and irrationally sits on applications with out approving them and for most of the July 2007 filiers finger prints has expired but USCIS is not sending finger printing notices.

    Does this mean that spill over is not "quarterly" as we've been discussing, but rather at the discretion of DOS as to when they will spill over?

    While the added text as explanation in the bulletin is appreciated, it really doesn't clarify anything for me, so somebody please explain!!!

    ..We cannot say things like exploitation or make the employers feel ...This is feed for the anti immigratin lobby..You put up stuff like this and they start painting you as their poster boy to show why the whole H1B program should be abolished......If we do conduct a strike ..it would cause no disruption at all..Frankly nobody is indispensible...Striking is equivalent of biting the had that feeds us...


    Well, one or two of us are dispensible but if unite in our effort, then we definitely become indespensible....did we really make an impact by making those thousands of phone calls for the lame duck?.....the fact is that an average american doesn't give a ***** about whether we get our green cards or not because they don't even know our pains.....and the government has too many other trivial and not so trivial issues to deal with than worry about us......lobbying is a good idea but we are still not getting the attention we should be getting......do you think they can really abolish the h1b program?.......foreign workers have become the veins and arteries of these companies and unless until you stop the blood supply, no body is going to even notice.......the dependency on foreign workers is more today that it was a decade ago just because of the sheer volume.

    How does removing the cap from Schedule A, benefit the rest of us?


    Nurses from India, Phi also eat up EB3 numbers beyond their alloted .... My understanding is that they will not compete for any eB3 numbers after this...

    people,

    i just returned from an infopass meeting... the guy i talked to said that they recently have a directive from the DHS/USCIS that they want to separate the legal stuff from the illegal stuff and hence they are planning to adjudicate a record number of EB apps in the next quarter or two... does anyone else concur? is this true or were my ears just ringing in that meeting?

    If you are beyond 6 years and I-485 denied then applicant is doomed weather you are in H1 or EAD. Only route is MTR. My attorney confirmed it.

    She suggest unless MTR get open. You should not even work to avoid the issues.

    So it does depend attorney to attorney. I don't think we have any case examples in either senarios. So bottom-line, do whatever you feel correct and make you happy. :)

    Personally, I think RG is seems more logical. If you use EAD your H1 becomes invalid. No one revokes but it happens. Similarly, H1 becomes invalid as underline petition get denied.


    Not really h1b is a different track all together. If 485 is denied and the denial is final - person is still free to work till h1b expires thats why lawyers say h1b is safer

    Who ever has got the idea of striking, picketing or hunger strike, it will not work here. Lobbying is the only way out for us. Well I guess someone has taken a cue from Mamta Benerjee. Well it surely works in India but not in United States.

    So lets stick to lobbying and calling the senators and addding members and contributing to help lobbying.

    Thanks to everyone who have already sent emails to Ombudsman. We need to do more to get positive results, please go to: http://immigrationvoice.org/forum/sh...ad.php?t=22182 and send those 4 letters.

    Others who have not yet acted on this, please go to that thread; download the 4 letters and mail them.

    As many people mentioned here and other web sites, the denials are continuing and we need to act now to stop this before it gets even worse.

    Another soft LUD on the 485 on 11/26.

    This is the 3rd soft LUD on the 485 (11/24, 11/25, 11/26) post sending AC21 and G28N documentation.

    485 status still says Case received and Pending.

    I hope this isn't followed by a denial, I have to travel outside the country in 2 weeks and it would be nice to not have to worry about this.

    The Mexico F2A and Employment Third preference cut-off dates" are �unavailable� for both August and September..blah blah..
    MAY BE it talks specifically about "Mexico EB3". otherwise it would have been: "Mexico F2A and all EB3"...

    AFAIK, this memo only applies to those I-140 petitions which do NOT require a labor certification approval. It does NOT apply to EB-2 Advanced degree holder petitions which require a certified labor and BS + 5 yrs or MS + 0 yrs of experience.

    Though, for now, most of us who are filing in EB-2 Advanced degree holder category have nothing to worry, this definitely looks like a targeted approach where they are coming after everybody, one category at a time. So its just a matter of time it seems when they come up with something which targets everyone...

    As per Matthew Oh's blog, this will be adopted on Sep 3rd.

    Not to put any dampers here, but this is extremely frustrating for the EB3 India folks. I mean how freakin long do WE have to wait before we get our turn!
    I am EB3-India with PD of August 2003. I am anticipating at least another 2 years. Any forward movement in any category is good news to me.
